Celtic Diary Wednesday May 11: Lawwell Goes On Charm Offensive

Hooray, there’s a game tonight, which should shift attention -for an hour or two-away from all the other guff thats flying around.

St Johnstones long season -it began in July-features its last home game, and they are without six players tonight, presumably due to fatigue, as they host five in a row champs Celtic.

Mackay, Lappin , Thomson, Davidson and Millar join on loan Celt Darnell Fisher-remember him ? -on the sidelines, but Saints boss Tommy Wright doesn’t think that’ll matter, as his side are finishing the season very strongly;

“We have beaten Aberdeen 3-0, Ross County 1-0 and now Motherwell 2-1 in the post-split fixtures and want to keep that form going in our last two matches at home to Celtic and away to Hearts.

“Celtic are coming here as champions and it has all the makings of a terrific match.

“My players have been excellent again this season. They have been superb.

“We set a club record of seven away wins earlier in the season and have once again finished in the top six.

“It is another great achievement.” 

As far as Celtic are concerned, there’ll be no Brown, no Boyata and probably no Charlie Mulgrew. There’s talk of a debut for Tony Ralston, who has been on loan at Queens Park, and is a right back in the mold of the current young player of the year Keiran tierney.

Maybe Ronny will leave some sort of legacy…

All eyes will be on Leigh Griffiths as he attempts to join the elite band of players who have scored forty goals in a season, and whilst he should be confident that he’ll make that total, sometimes the lad gives the impression that he tries a little too hard.

Tonight is his last game of the season as he is suspended for Saturdays Motherwell game, and whether or not he hits the forty, he’s had a splendid year, and fully deserves a break.

On now to the guff, and Celtic will apparently hold talks with Brendan Rodgers today, which will surprise a lot of people at Celtic Park, as it is now almost certain to be Roy Keane who takes up the reins after Deila exits stage left. They’ll be surprised as they have already been told.

That won’t come as any surprise to any diary reader, nor will the news that Martin O’Neill will join later as a director of football.

However, as Keane is quite an impulsive chap, I still wouldn’t put a shiny pound on this with the bookies, but then again, I wouldn’t put a pound on it raining later if a tornado went screaming past my front window.

In response to a fading public image, Chief Executive Peter Lawwell has given an exclusive warts and all type interview with the Sun, so no matter what he says, it’s probably going to be different from what reaches the printed version.

Whilst there’s an understandable urge to avoid the Record from club insiders, choosing the sun so soon after welcoming the Justice for the 96 people to Celtic Park is a massive PR blunder.

It’s unfathomable how someone at Celtic Park didn’t consider all the bases when assessing the reaction to the interview, and no-one foresaw the outcry which started last night on social media, and will continue for days yet.

The interview itself is fairly straightforward, and long on style but short on substance.

Firstly, he was asked his thoughts on what fans think of him, something i’m still not entirely sure he’s fully aware of.

 “Supporters are very much entitled to their opinion.

“When things don’t go as well as they hope then there is always somebody to blame. In terms of the banners I don’t take that personally.

“I take it as a sign of the times, but the answer is this: If I’m not here, then there will be a new me.

“And he’s not suddenly going to find tens of millions of pounds stuffed in the bottom drawer. And he’s only going to try and do the same things that I’ve been doing to maximise the future of this club.

“Listen, I can understand why people on the outside looking in have their opinions but they don’t actually know how the club is run.

“We see it at the Emirates, we see it at Goodison and Villa. That’s where we are in today’s society. When supporters become frustrated and disappointed they look for people to blame.

“At first it was Ronny who got it and he’s now going so the sights are trained on me but my view is that, as a club, we’re in very good shape. 

“We’ve had a very, very tough year but we look forward with a new manager and a new beginning.

“At the moment I’m focused on getting the right manager in and preparing for the new season.

“Criticism is par for the course when you’ve been at the club as long as I have. There are going to be lows and you’re going to get it in the neck. It’s the same for Dermot who’s been here even longer.

“I can understand why it happens because the supporters always look for more. But my life is based on reality, not perception. I know exactly where we are as a club. We’re in a good place. 

“If I decide to go or the board decides it’s time for me to go, then the club is merely going to get a new me. Now the new me might be better but he might not be as good. But the club will continue down the same track.”

In one sense here, he’s simply saying that its not him who is unpopular, its the policies. He’s right , to an extent, and it isn’t too far away from the truth to say that he is the focal point of fans disenchantment, but he’s mixing up Peter the person with Peter the CEO.

 What he is doing is playing down his role in within the club, and thats the wrong route to take.

Really, if you are under pressure, you should point to what you have achieved, and not that someone else would do exactly the same.

And as for looking for the right manager, oh come on, we know who it is, we know when he’ll be here, and we even know that Jim McGuinness will take training until he arrives, on the 29th of june, or thereabouts.

Then it was time to remind us that we’re lucky to have him, but instead of telling us why, and there are several reasons, he reminds us that other clubs were willing to pay him much more…

 “I love the club. If it was about the money I wouldn’t be here. I’ve had opportunities to go — for a LOT of money — but I chose to stay.

“It’s not just been one opportunity either. But Celtic is my life. It’s more than a job, it’s a passion.

“I’ve supported Celtic all my life. I’d like to think when I do eventually go I can look back and say: ‘I did this, that and the next thing’.

“You’ve got social media and the bloggers, posters and trolls who think they know what’s going on at the club. They don’t.

“They don’t have all the information. The reality is different from their perception and I need to deal with reality every day.

“But criticism comes with living a public life in 2016. People dislike me having never met me, but that goes with the territory and you either put up with it or you don’t.

“And at the moment I’m putting up with it because I’ve got things to do. But I’ll be honest, the job is all-consuming, it’s 24/7.

“There is very little time in my life when I don’t think about Celtic and my job. 

Er, for most of us Celtic is 24/7.

And a wee bit more than that.

He then talks about the reality of playing in Scotland, and its far and away the most revealing and accurate part of the interview;

“We’d love to go to the new manager and say we have a £40million warchest or a £50m warchest to buy the best and go for it.

“But we play in Scotland, we don’t have that. The reality is we don’t have an alternative to what we’re doing. For me that’s an exciting project for the right manager, the right guy. This is Celtic.

“It’s an iconic club, one of the biggest in the world. Even today we’re highly regarded as one of the best-run clubs in Europe.

“There is an excitement here which should be an attraction for somebody to come, get a hold of it and take us back into the Champions League.

“If your ambitions are to win the Scottish Premier League and move on then I can see that. But our ambition is to go further so for me it’s a very attractive proposition for somebody who wants to come in and create something.

“We get criticised for our strategy but I just don’t see any alternative. Everything we take out we put back in. But that’s it.  

There are alternatives, however, if you look for them.

The main one is the scouting policy. Employ proper scouts who spot players, instead of asking agents who they have that might fit in.

Credit to Lawwell for trying to connect with the support, and trying to keep them informed, but I have to ask, why would he do it in the Sun ?

It is just the start of a few “interviews ” this week, so maybe he’s just getting the bad one out of the way first.

Of course, the most significant issue was left out, as it is kryptonite to journalists, and by ignoring it Lawwell has simply added fuel to the fires of conspiracy.

And surprisingly, for both you and I, I’m going to say something , and i’m going to ask you to trust me, or at least bide your time here… because, lets just say this is how I would word a statement were I to be asked….

Celtic have done nothing wrong in regards to this issue. 

Celtic are continuing to work with a group of people around a suggestion that rules may have been broken. 

Everyone concerned is upbeat about how things are progressing

When that investigation reaches a conclusion, the club will announce how it will proceed. 

I’m going to put what little credibility I have on those words…

It’s amazing what you can find out when you just ask people.

Anyhoo, I noticed that amazon, the online movie and tv company, have a documentary featuring a look at how “rangers ” will get on in next years Scottish premier – it looks quite good.

It’s called “The Walking Dead Season 5”

The BBC come under a lot of criticism for their piss poor football show “Sportscene,”, and its unfair just to criticise and not offer up your own ideas.

Well, maybe they should look at how its done in Italy;

Especially as the show is shown late at night, as it would mean you could truthfully tell the wife you were watching the football, and not have to beg the lass on Babestation to hide behind the couch because you’ve lost the remote control and she’s coming down the stairs to see what you’re up to.

Was a bit underwhelmed with Peter’s interview, was expecting something more. As for the ‘Sun’ exclusive? was the interview not given to several MSM? My main concern is how this will effect our ability to pull a manager.

Ralphy, I for one believe that the club and the Res12 guys are working behind the scenes to carry this forward,they would be stupid if they did not,and they are not stupid.
P.Lawwell was insensitive to carry an interview in the sun newspaper,because of the Hillisborough 96 and well because its an arse wipe.I cannot wait until sunday when hopefully we will not have to listen to any more rhetoric from R.D,the guff that he spouts is mind numbing.
Please Celtic bring in a manager that we can relate to and spend our cash in a more productive way on new signings.H.H.

I am disappointed that Lawwell chose to speak to that paper, again the PR department need removing and install a Celtic man or woman who knows the varied minds of the Celtic supporters. You can’t please everyone all the time but there is a benchmark. Speaking to a paper vilified by a support we have stood side by side over Hillsborough leaves me having to explain a few things to my Liverpool supporting family, friends and colleagues down here in the North West. It is embarrassing for me and the disappointment in their faces is clear to see.

What the fans do have access to and can see with their own eyes ( not what they apparently read in the papers) is the standard of the first team, we can see where we are and it isn’t a nice place, we are underachieving.

Lawwell has a point Monti only recently after you requesting it I should ask I provided you with the facts regarding the £14.4m we owed the Co-Op a few weeks ago and you dismissed it as “Pish”.
This is what he is up against on a daily basis.
Whilst I don’t sympathise with the way he and Celtic go about portraying these things I do get what he is saying about knowing more than ANYONE commenting on these things.
If you happen to be reading this MrLawwell TRANSPARENCY on all matters is all we ask for.

When it comes to protecting the club from financial excess you are correct C.S. they do a good job and yes you are correct that we have to be aware of building up big debts.
Because of that i personnelly believe that we need to spend aprox 10 million pounds on 3 new team players.A strong centre back a ball winning defensive mid. and a strong better quality striker.The young right back Tony Ralston will fit the bill in that position.How do we raise that 10 million pounds,that should be relatively simple bearing in mind the huge number of excess players at the club,along with the new sponsorship deals and the new cup competion friendlies.

Canny argue with any of that exactly the approach we should be taking.
One thing I will say is though we should be targeting the finished article no more “Potential” or cheap options.
We need solid performers who will come in and make an impact immediately in Europe.

He gave an interview in the Sun because he gives so little a toss about what supporters think it didn’t even register with him. Also, if you believe that his role in the Sevco saga is anything other than helping them back on their feet to have the repugnant Old Firm nonsense back then buy two season tickets you mug. Keep giving them your cash because nothing is going to change. They do not want it to change. And when the international win the league Pete will insist that Celtic applaud them onto the pitch. Afterall it is the staus qup that must be maintained. Two cheeks of the same arse? i am sickened by the whole Scummy Tory lot of them . They have shamed Celtic and betrayed the support. Couldn’t disagree with you more on this one. Both the content and venue of the interview are evidence Lawwell (2 W’s) is both arrogant and hopelessly out of touch with a large section of the Celtic support. The interview is a textbook example of how NOT to conduct PR. As such, it is exactly what I’d expect from the current bumbling PR approach at CP. in fact, that is one of the grievances I and many others current have with the club. Lack of spending is in fact not currently an issue (though how funds are spent is), which of course Peter spent most of the interview discussing.

I agree completely, Keane is going to the Euros and we need someone in asap. I don’t mind the lack of announement now, but once our final game is done it should be announced and the new guy has his work cut out from day one. I’m guessing all the players shoot off on holiday from Monday, who is spelling out to them what is expected/required of them during off season and what condition they should be in when they return on xxth June? If Keane is the man, he won’t be involved in signing players and talking to those he wants, and as soon as we accept his “late” start, we’re accepting failure in the UCL qualifiers already.
Get the new man in now, start preparing properly now, and protect our fragile UEFA coefficient with everything we’ve got. Another year missing will be hard to take.

Gerry, i am not saying it is Keane,i dont know who it will be but there is no way that he would allow anyone other than himself to pick any potential players.
I suspect that MON would allow him to leave early or at least prepare for the new season,the job he does now will not take up his full time.So if it is him then he would begin now working behind the scene.I also believe that he would be sounding out potential Irish players and that D.D.would open the purse strings more for him.

What’s wrong with Lambert m8 great player for the club,and outstanding at Colchester Norwich kept villa in the premiership,and steadied Blackburn. More than Keano has ever done.
Rodgers, Di Matteo, Hiddink, Michael ONeil, would all be above Keane in my opinion,and do a much better job.

I don’t know if anyone has seen this movie but I watched that Tina Fey movie “whiskey Tango Foxtrot” on the plane yesterday. Not a bad movie – I particularly loved the way she spent a large chunk of the second half wearing a Celtic scarf – superb publicity (including improvising a hijab out of it at one point). Great Stuff.

Since publishing our report we have had a number of people contact us about a post elsewhere which questioned our conclusions on the grant of a UEFA license to Rangers in 2011.

Further to this we have been in email communication with the writer/s of the post and discussed their position. We would like to note that they put their comments in a constructive manner and we engaged in a positive and interesting conversation. We found our correspondence a useful exercise, however, as will become clear from this post we do not think that the criticisms levelled raise any problems with our conclusions and stand by our report 100%.

We are happy to take this opportunity to respond to the issues raised so that people interested in our report can better understand our position and the reasoning behind it.

THE PURPOSE OF THE UEFA FINANCIAL FAIR PLAY REGULATIONS
Before dealing with the specific criticisms raised, it is important to keep in mind the purpose of the UEFA Financial Fair Play Rules (FFP). It is clear that the purpose of the rules is to prevent clubs from gaining access to economic resources they would not normally have through being late with their tax payments. This is to prevent teams gaining an unfair financial advantage over clubs that were up to date with their tax payments.

The DOS scheme was operated by Rangers between 1999 and 2003. Taxes on payments made though the scheme first became due in 2000, and in subsequent years for subsequent payments. However the club did not pay the liabilities as they came due, and concealed the payments through the use of of an offshore trust (note, this was a different trust structure than the Big Tax Case). Rangers then lied to the tax authorities when they were questioned about payments made though this scheme in 2005, denying the existence of side letters.

The club were later caught out, when the documents came to light during an unrelated police investigation. This led to an accusation of fraudulent conduct made against the club by HMRC. The club then accepted that they needed to pay, and entered into discussions about what the remedy for their conduct should be. In the end the agreed penalty was never paid. To be clear, although we will expand on this below, this is very obviously not a situation that the FFP rules ever intended to sanction!

THERE WAS NO OVERDUE TAX BILL
There has been a long discussion on the internet for many years on the question of when Rangers’ tax liability arose. People on different sides of the argument have dissected in detail the correspondence between HMRC and Rangers in 2011 in an attempt to resolve this issue, yet there is still a lot of disagreement. Our view here differs from many of the commentators we have seen, including those backing ‘resolution 12’.

The FFP rules refer to the need for payments to be made in line with “the agreed terms”. To be clear, we take the agreed terms to mean the statutory obligation to pay taxes. In the case we highlighted the relevant statute is the PAYE legislation. That deadline under these rules for tax relating to payments made through the DOS scheme fell in 2001-2003 and that is the date we consider the liability to have become “overdue”. That interpretation is in line with the way UEFA interprets the rule as set out in the Malaga case, and the way the Italian courts have interpreted it in the Parma case (see below).

If there is no payment by the due date, a club needs to have a written agreement with the revenue authorities to extend that deadline. At no point did this happen in the DOS case.

It is for that reason that we regard Rangers to have had an outstanding tax payment on March 31st 2011 and their characterisations of those payments – as ‘potential’ and ‘postponed’ – to be inaccurate.

It has been said that the liability only became due when the settlement with HMRC was agreed, or alternatively when the appeal period for the Section 80 notices issued by HMRC expired. We believe that interpretation to be wrong, because it would entirely defeat the purpose of the FFP rules. If we were to accept that interpretation the effect would be that a football club would be free to mislead the tax authorities for as long as they didn’t get caught, and would still be regarded as in compliance with the FFP rules. Even then, when they are caught there would only be a liability when the penalty is agreed. As long as discussions are ongoing, there would be no problem with the FFP rules. This is plainly ludicrous. We do not think that it reflects either the intent or the meaning of the FFP rules.

It has been said that correspondence between HMRC and Rangers shows that there was no settlement and therefore no agreed terms. For the reasons set out above, we do not think that such correspondence is material.

NO REQUIREMENT TO HAVE NO OVERDUE PAYABLES
The next argument is that the only obligation under rules is to declare an overdue payable, not to ensure that no overdue payable exists. The evidence used for this is the paragraph in the rules which sets out the details of the information that should be provided in the licence application. That paragraph says:

The following information must be given, as a minimum, in respect of each employee: a) Name of the employee; b) Position/function of the employee; c) Start date; d) End date (if applicable); e) The balance payable as at 31 December, including the due date for each unpaid element; and f) Any payable as at 31 March (rolled forward from 31 December), including the due date for each unpaid element, together with explanatory comment.
It is said that this paragraph shows that all that is required is an explanation of an overdue payable, which Rangers did provide. Given our views on when the liability became due, we do not believe that Rangers did provide the minimum information required under this paragraph. In any event, we do not think this is a valid criticism because we believe that this clause is broader than overdue payables and encompasses liabilities that have not yet fallen due.

This we think is clear from the proceeding paragraph which states:

“The licence applicant must submit to the auditor and/or the licensor a social/tax table showing the amount payable (if any), as at 31 December of the year preceding the licence season, to the competent social/tax authorities as a result of contractual and legal obligations towards its employees.”
In our view the reference to the unpaid element does not only concern overdue payables but includes liabilities that have arisen but have yet to become due. The PAYE example is a good example of why this is important. A football club throughout the year will be withholding income taxes from its players every month though their pay checks. However, PAYE is only due to be paid to the tax authority shortly after the tax year in April. There is a timing difference between the liability arising and the due date and it is therefore possible that the club may have accumulated tax liabilities which are not yet due – and of course, this is important information for the regulator.

It is the same with self assessment. If you do self assessment tax returns, you pay some of your tax on account, and then when your liability is calculated you have some time to pay. Your liability will be less than your due amount, some money already having been paid on account.

It is our view that this requirement to provide information is part of the obligation on clubs, in order to allow licensing authorities to more easily monitor tax payments, to make sure that the club has understood their payments correctly, and to make sure that payments have not become overdue. The importance of this becomes clear with the Parma case (see below).

RANGERS WOULD HAVE GOT THEIR LICENCE ANYWAY
The third argument put forward against the analysis in our report is that none of this matters, because whatever the process Rangers would have got their licence anyway. The evidence here is the Malaga decision, which is quoted in our report. The argument is made that the Malaga case was much more serious, as the tax liability was several times the liability Rangers had. Malaga originally received their licence only to have it taken away when further liabilities were discovered. This is taken as evidence that Rangers would have received their licence anyway because their liability was much less to begin with.

In our report we accept that the Malaga case was more serious, and that it was open to UEFA and the SFA to grant a licence to Rangers if everything was properly declared. However, it is dangerous to rely on Malaga case as a precedent in this regard.

Consider the Parma case. Parma was denied a license in 2014/15 for having an unpaid tax bill of 300,000 EUR on March 31st 2014 despite fact that the Italian tax authority only first contacted them about the matter in April. The payments were in relation to 10 players they had on loan, and Parma’s understanding of the relevant tax rules was that the liability was only due in June.

In this case the authorities took a strict liability approach and decided that Parma fell foul of the FFP rules by not paying in line with their statutory obligations, even though they (i) had made a genuine error of judgement about what those obligations were (there was no allegation that they deliberately tried to hide the position); and (ii) they had not been informed of that error by the relevant tax authorities. It was their obligation to know the law and to follow it without the need for the intervention of the authorities.

The case also highlights why part of the licence requirements is to declare liabilities that have not yet become due (as discussed above), because that is the only way in which the Italian football authorities could have known about the issue.

Had the SFA taken the same strict liability approach, on this precedent Rangers should certainly have been denied a license. However, we do stress that we are not in the business of deciding what the correct decision should be, had the authorities had all the correct information in front of them. We simply make the point to highlight the danger of relying on one precedent when others point in the other direction.

This is the conclusion we drew – which, note, does not indicate whether or not a licence should have been granted:

The key point is this: the SFA had the right to check with HMRC directly the status of Rangers in respect of tax liabilities (that is, of overdue payables). From public information alone, no regulator could possibly have argued against carrying out such a check. And such a check could only have provided the answer that there were indeed overdue payables – either at 31 March, 30 June or both.

We do not know if those checks were not carried out, or if they were carried out and the results ignored. In either case, there was a fundamental failure by the SFA to meet its responsibilities towards Scottish football.
We hope this clears up some of the questions that arose from the report we published last week.

For those that are asking, we have yet to receive any response to our report from the Scottish Football Authorities. But to put that in perspective, it took ten years for the original proposals made by the Tax Justice Network after we were established in 2003, to become the global policy agenda at the G8 and G20 meetings in 2013. And we’re still working on making sure they are fully enacted, and that they fully include developing countries – which suffer most from the damage of financial secrecy.

The game was as corrupt before( (couldn’t even Knight him) but Jock knew this and built a dynasty to combat it. That is the way forward in Scotland first.

Steve, I do not want to put the club in peril,by a huge spending spree.I truly hope that we get the next Manager that can have the impact that we deserve and that can move us into the C.L.Qualifiers.
I hope that the club can bring in three first team players right into the squad,to blend with the ones already here.
I want the club to fight our corner at every level and show that we will not be intimidated by anyone.This requiers a good P.R.department.This along with a P.Lawwell bypass as our Director of fitba (MON)would be just great.H.H.

So we fall 2-1 to St J…in essence a summary of the RD era. A modest team with a system and some desire knock off a group(not a team) of superior players. A team and a coach who do not care enough about their performance fall again. But hey ho, we have a youth system that will supply a max of two players to the top team and we have a great legacy as a European team.
Be afraid, be very afraid this is a club in serious decline. Does it have the leadership to survive mediocre? How does it compare with Villareal or a Dynamo Zagreb or a host of other Scandinavian and East European teams?
I am afraid that a change of manager is not enough. If this club was on the ball, it would have a candidate to put in place by the season end. It is beginning to look as if the search is continuing….very disappointing and totally unprofessional.

Celtic time to show that you are not third tier and aspire to second tier. Time has run out.

A new Management team,a real Director of Fitba,with a bit of cash and with D.D.or his ideas behind Celtic then perhaps,just perhaps we will move out of this downward spirol.

Maryhill you are correct,it was my disapointment speaking and not my head.Having said that i am not a big fan of Allan,IMHO he is too small and to slow,Christie looks a bit light but he works his bollocks off and i would like to see much more of him and Ralston as well.He Christie is always looking for the ball,a very good sign,unlike Allan.
There was too many changes included in the team tonight,my view is that there should only ever be 2 max per game,

With all respect guys, I think you are looking too much into this.
St Johnstone are a well organised team,but we let them off the hook,too many passes too greedy in some areas,but it was a worthwhile exercise. Poor Effe again,yes I know he’s a nightmare,but he tried to header the danger away,if the goalie shouts then it would have been cleared,it was offside in the first place but hey ho those things even out over a season so they say. If Effe hadn’t have moved for it he would have got grief for not competing for the ball. Their first,well that’s what happens when you fuck about,never mind the divot,the ball should have been away from the danger zone straight away.
Supporters on here were crying out for Janko Christie Allan to get game time,so they got it.
We had plenty of the ball,but not good enough in the final 3rd.
It wasn’t the managers fault tonight,just one of those end of season games. Hail Hail
