Twenty Questions for Scottish Footballs Governing Bodies to Answer

With rumours flying around the City of discussions  regards the finer details ( and impact )  of the Administration process between a certain club and SPFL \ SFA officials, we find ourselves asking..

1: When does a season end? When a league campaign is over ( SPFL) or the Scottish Cup final Whistle (SFA) or is it up to the discretion of the Governing bodies? 

2: If a title has been awarded, can that campaign be deemed as over and any Administration points awarded move onto the next season?


3: If a license has been transferred, should any club playing under that license, that goes once again into Administration within 2 years, suffer additional penalties?


4: What is the point of the new SPFL if it cant take a strong hand in dealing with serial offending clubs, has nothing changed?


5: Shouldn’t the SPFL be able to place a representative on the Board of any club going into Administration to ensure proper governance.


6: Should all clubs be forced to pay into an SPFL Escrow account to ensure proper funding is in place to cover principal footballing costs before any season begins.


7: Should a club that has been refused Credit and the use of Credit based facilities be allowed to owe monies to football related entities?


8: Should any club that has already suffered a transfer embargo in previous 2 years due to financial difficulties,  and then goes into Administration, be handed another extended transfer embargo which can only be terminated at discretion of SPFL and full account sign-off
?

9: Should any club with Audited accounts deemed “An on-going concern” be docked points to prevent likelihood of further irregularities and escalating into Administration.


10: Should a club that goes into Administration twice in 3 years (we know, we know!) have its license revoked by the SFA if another solvent club has submitted an application, ie Spartans


11: Should a club be forced to lodge its grounds deeds with the SPFL to confirm ownership?

12. Who determines a potential club director or owner passing the fit and proper test? i.e. What are the rules they must pass from a governance perspective and who approves this?

13. If the auditor of a clubs accounts “indicate the existence of a material uncertainty which may cast significant doubt about the Company’s ability to continue as a going concern”. Shouldn’t footballs governing bodies immediately intervene? 

14. Should a club that wins promotion in the same season as an insolvency event be allowed promotion ?

15. Should a club winning a trophy in the same season as an insolvency event be allowed to keep that trophy ?

16. Should a club (we know, we know) which has entered successive insolvency events be required to place a financial sum with the SPFL as a guarantee to continued solvency?

17. Should any board member involved in an Administration episode be automatically banned from serving at any Club?

18. Should any club entering Administration be banned from Cup competitions?

19. Should any club entering liquidation and having license transferred be banned from domestic Cup competitions in similar fashion to UEFA’s 3 year rule?

20. If the clubs own auditor states there is an “uncertain outcome of potential litigation”, which relates to letters before claim issued by Craig Whyte, the previous owner of RFC 2012 PLC (now in liquidation) and Aidan Earley….and…… that despite the company having conducted an “independent investigation”….and…..despite the “inherent limitations of a private enquiry” from which the company concluded the claims has no legal merit……the “ultimate outcome cannot presently be determined, and accordingly no adjustments have been made”. If the clubs auditor states all this shouldn’t Scottish football’s Governing bodies be all over this like a rash demanding answers?

They recently slipped through a rule change, (mid-season) that allows a team to be promoted even if they have another administration event. How long has the SFA and The SPFL known that this was coming? Why did they get a licence last year when their own (cooked?) books shows them losing £1mil a month? They have won their last 2 trophies using money they couldn’t afford. Cheating Bassas, Then, Now and Forever. HH

Anyone else notice the contrast between the NBA commisioner’s reavtion when confronted by racist behavior — quick reaction, life ban, $2.5 million fine — and that of the Scottish football authorities when confronted by the same behavior?

racist behaviour must be backed up by reputable sources ,your snakey refererence to L G is still under investigation no doubt by GCHQ who are the only ones in the U.K. who could give the procurator fiscal any ammo from a mobile phone .

Answer to question 21 from Monti, ” 2 PLEASE.”
The blatant establishment corruption just keeps on going with very little resistance from any other club Chairman ( CELTIC), a blanket refusal to play the first 3 games of the season by every fully paid up club in all Scottish leagues that are not in or on the brink of administration should be upheld, financial pressure put on the SFA ect would surely bring about change at the top..HAIL HAIL, KTF

Q22: Why are you such a shower of spineless jelly-legged cowards? And why did you use the threat of ‘civil unrest’ when justifying the “nothing to see here, everyhting is normal” approach to the club formerly known as Rangers?

Don’t suspend yourself by the tender parts whilst awaiting meaningful answers.

The best you will get is, a Fifth Amendment plea of ‘We don’t deal in hypothetical questions@.

The 20 answers you will (not) recieve:

1 – The season ends after the league campaign. A point penalty would have no impact to a cup competition.

2 – No. If it happens before the season ends then the title can be stripped and be competed for. (this actually happened to me playing amatuer)

3 – The limit is 5 years and the additional penalty is 10 points

4 – Practically nothing

5 – This would come under insolvency law

6 – Would put too many clubs in further debt w/interest

7 – Would be between individual clubs

8 – No, could be challenged in court as a restriction on trade

9 – No, could induce false accounting, misleading shareholders and other unlawful acts in order to chase onfield success

10 – No, same as Q3

11 – Anyone can check the land registry

12 – The club give an assurance

13 – Same as Q9

14 – Yes, same as Q8

15 – Yes

16 – No, the club would have to give a written guarentee (essentially not worth the paper it’s written on)

17 – No, but under company they can’t be a board member for a length of time (piss easy to get around this)

18 – No

19 – No, would affect too many innocent parties eg Meadowbank/Livi

20 – No, the SFA/SPFL cannot pre-empt court proceedings
