Celtic Diary Thursday April 28: SFA Reply On Resolution 12

At long last the SFA have actually replied to a letter from solicitors (sent last Wed),and it makes for very curious reading.
 
 
It answers no direct questions concerning the main issue and seeks to avoid all questions.
 
 
It states clearly that the SFA do not consider themselves answerable to the individual shareholders of Celtic PLC or the shareholders of any member club.
 
 
It states that in 2011 the SFA fulfilled its licensing and UEFA monitoring functions fully and properly.
 
 
It states that those monitoring and compliance functions came to an end at the close of that particular season in respect of that same season and that it is not obliged to make any report in connection with the events of that season after the close of the season. You follow?
 
 
However, it goes on to say that the SFA will co-operate in every way with any enquiry that should be opened by UEFA in the event of issues being raised by someone else.
 
 
The letter arrived yesterday afternoon, was copied to Celtic PLC, and is only being considered today.  

If anyone thinks this brings matters to a conclusion they are ill informed.

I read that as we haven’t done anything wrong and we don’t have to explain ourselves to you anyway. But if UEFA asks us, then we will.

The fat lady hasn’t even sprayed her throat never mind cleared it. For all SFA say they do not recognise shareholders,  in replying they just have. One  up to the fans. They are being made accountable but no reason now for Celtic not to takeover the mantle.

In replying the SFA have brought their raison d’etre into question and clearly they and UEFA need to investigate, if only to ensure no holes in their process that let a club with tax so overdue it required SOs to call and collect 6 weeks after being cleared of having none, play in  CL qualifier at end July.
Had RFC beaten Malmo and qualified I very much doubt if Malmo would have stayed silent after 10 August especially as their opponents had a player that RFC paid for with the overdue tax money.
This is an extremely serious good governance matter and it cannot be allowed to be swept under the carpet.

As the CQN post says the response is still being digested, but Res12 asked for the licensing process in 2011 to be investigated. Celtic’s response based on partial answers to questions by the SFA to avoid the relevant date was that the resolution wasn’t necessary. 

That position in our view is no longer tenable. 

I hope supporters of other clubs will start asking their clubs if they support Res12 for if they do we can finally get SFA clear out then closure.

The coming weeks will be crucial for the integrity of Scottish football.  

Celtic can now take up the battle, and indications are that they will. The volume of supporters who have registered their displeasure at their apparent inaction has bewildered the club, and they will react. I had a chat with someone yesterday, and was quite happy with how it went.

 There will be more on that later, but for now, it appears the club, the support, the shareholders can stop arguing amongst themselves, and focus their attention on the arrogance in that letter from the SFA.

Especially this bit….

Legally obliged ? Maybe not, but thats irrelevant, because even if they were, they’d just change the rules to say they weren’t.

Morally obliged ?

Well, thats a wee bit different.

Failure to report all the facts suggests that they may have something to hide. If everything was tickety boo, then why not come out and say so?

To do that may restore a little faith in those who govern the game, who surely must be feeling a little bit of pressure as accusations are being made that they may not have been entirely honest in their applications of the rules.

If they aren’t feeling any pressure, then that can only be because they genuinely don’t think they have a case to answer, and that in itself means that they really do see themselves as above the law, above accountability and beyond reproach.

Not really how it should be, and not really how they would want to be seen.

After the shennanigans of 2011, and the subsequent bending of rules, one would think the SFA would want to be open, would want to be honest and would want all those accusations dealt with, not only to show they are capable of good governance, but to show they have the games best interests at heart.

A refusal to confirm that they acted correctly when submitting and confirming the application of Rangers ( 1872-2012) for entry into the Champions League suggests that they may have either deliberately or accidentally made an error.

If they have nothing to hide, surely they should show that, and then we can all move on.

Their own personal integrity, and the integrity of the governing body is being called into question, and it is simply not enough for them to answer this by saying

“you can’t make me “

The thing is, they have to realise that somewhere down the line, someone is going to make them, and it would look an awful lot better if they held this enquiry of their own free will, because the longer they procrastinate, then the more it looks like they are afraid of what may be discovered.

As a supporter with an interest in this issue, perhaps you could contact them and demand an enquiry into the events surrounding the granting of a licence to Rangers (1872-2012)

Regan hasn’t had his problems to seek since he joined the SFA. Here he has a chance to prove that his primary interest is in the well being of Scottish football. with a show of strength and leadership, leadership that the game is crying out for, he can show that he is a true leader, in chrge of an organisation we can all be proud of, an organisation to take the game forward under his stewardship.

He has an opportunity to grasp a situation which i threatening to spiral out of his control and do untold damage to the game, not only in the yes of sponsors and investors, but in the eyes of supporters anywhere.

By taking firm action, and doing what is right, he can show us that he is indeed a leader worthy of praise, and he can write his name firmly in tha annals of Scottish football with a legacy he can be proud of.

He could be the man who restored our faith in an organisation that at the moment is seen as a little parochial, a little arrogant, and dare i whisper, a little corrupt…

Or you could even tweet him…

Give him encouragement, come on Stewart, show us what you can do ! sort this mess out, and show us there’s nothing to hide….

Point this out to him in your email, be nice, but  be firm.

Scottish football needs a leader-and Stewart has a chance to be that man.

Celtic have taken notice of our concerns, and its all down to you guys who let them know how you feel.

Contact Regan and the SFA.

Be nice, after all, we want what they want, an honest game that we can be proud of.

We want leaders we can trust, and if they have done nothing wrong, then show us, and then we can put all of this behind us and move on.

You see, until we’re sure, until this niggling little doubt we have is erased, then we can’t move on.

Its still their call, for now, so I’m sure they can be convinced to do the right thing.

 

Now, with all the fuss over the possibility of dark and dastardly deeds way back when, it may have escaped you notice that theres a chance of winning the league this weekend.

The fifth consecutive title, and as this hasn’t been done since 1971, its worth looking forward to, and its worth remembering that we aren’t here to chastise the SFA, or the club, or any of the individuals running the club.

Not when there’s a game on, anyway.

And its not going to be easy.

All we have to do is give one performance on and off the park that secures the title.

Whatever happens, nothing must get in the way of five in a row.

If it does, the earliest we can hit the coveted ten is 2027, and i don’t know what I’ll be doing then, but it will almost certainly involve twenty four hour supervision.

Celtic have let us down a few times this season, but so do all our friends and loved ones.

Whats important is that we care enough to be angry, and we care enough to put it right when it matters.

And we do it together.

Morning Ralph,
Just finishing my bacon and eggs (My partner made it obviously, well trained lass), Regarding res 12, I hope this is pushed to a satisfactory conclusion, this is the time to take the SFA to task, do it now and life will be easier in the future.
As for Tynecastle at the weekend, I’m not expecting a win, nowhere near it, this manager and a number of players have left me feeling utterly underwhelmed with the whole thing.
Hopefully we do 5 in a row and get over the line, but I won’t be celebrating that, not at the moment, not the way I feel! HH

If the CFC board were going to take Res 12 and LNS to CAS/UEFA they would have done so. I think it’s time to wake the Celtic support up to the fact, that the CFC board are ‘blazer wearing, brogue stomping’ part of the ‘Scottish Rite’ establishment.

So yesterdays caption was about beating women (I had an ancestor who was beaten to death in Govan police station, her crime was walking the streets with her children, as she had nowhere to go.) and today’s is about mutilating children. Classy.

Resolution 12. The battle makes me proud to be a Celtic supporter. I think truth will out. Like Monti, I believe the Sheep will gift us the league rather than us winning it with flair and style. Jimmy he has been recalled i believe because he was injured,i would bring Lustig into C.H.and play Janko at R.B. if Boyata, Mulgrew and Sumo are all out injured or Efe at R.B. if Janko is still not fit.

As a football fan, and as a quality professional, I would be grateful if you could explain to me how the issues regarding the irregular payments to players and the total lack of financial probity of the now defunct Rangers was allowed to take place under your jurisdiction.

In addition, how was a chairman who was a member of a board of a company that was liquidated in 2012, and who has 42 convictions for tax evasion, was allowed to pass your fit and proper person test?

My next point is how a club that was liquidated, shedding its debt, becoming known as Sevco, is now paraded as the same old company, with the same strip, badge and colours claiming the history of the old club, yet still avoiding paying the fine levied against the “old club”? This seems to be a subject unable to be discussed as some reporters and newspaper people have found out to their professional cost.

Where does this lack of financial rectitude leave the people and companies who were left out of pocket when the club was liquidated in 2012?

All these things happened under your watch Mr Regan, yet all you seemed concerned with was looking out for the wellbeing of a single club at the expense of all principles, morality or honour at the cost of the reputation of your organisation, yourself personally and professionally and Scottish football as a whole.

Just in on another site.
Today Mike Ashley surprised many of us by dropping his legal case against the SFA over Dave King’s “fit and proper person” status.

This ought not have been so unexpected; Ashley’s legal team has clearly dropped the ball more than once in its battles with King. It makes me wonder just what in the Hell their overall objective was, if they were so unprepared to go the final mile.

That’s a small matter at the moment.

What matters right now is that the SFA’s lawyer asked the judge a somewhat bizarre question relating to Celtic’s shareholders.

The SFA’s lawyer asked the judge if Ashley’s action means that “Celtic shareholder could sue the SFA” in the event that “King does well.”

Yes, read that again. And again.

And then read between the lines.

Because for openers, Ashley is a shareholder in the company King sits on, and he was the subject of an SFA fine under its dual ownership rules. His challenge to the SFA came down, as much as anything, to asking them which of their rules they take seriously and which they don’t.

That he hasn’t proceeded to the logical conclusion makes me wonder if this is all some kind of weird game he’s playing, but it’s irrelevant for the moment.

In the SFA lawyer’s question, you can see the contempt they have for anyone seeking to hold them to account, and I think the mention of Celtic shareholders suing is more than just a reference to this case and goes to the heart of Resolution 12 and other issues.

This is them saying “Back up and back off.”

And you know what?

Not a chance in Hell.

They can send whatever little subliminal messages they like, through lawyers and PR reps and media men. As I showed last night in my article on Resolution 12 (you can read it here, and please do, and share it too) they are caught, bang to rights, on that one and the evidence I’ve seen is a fraction of the overall.

King is not a fit and proper person to be on the board a Scottish football club.

He’s a serial liar, a convicted tax crook and was on the board of the OldCo when it died. He’s dealt in evasion and half-truth and outright falsehood at every stage in his dealings with other clubs, the governing body and even his own fans since he got the chairman’s seat.

The SFA has, once again, allowed the wrong guy to take over a club at Ibrox, without proper oversight, without proper scrutiny, caring only that they don’t upset the apple cart over there, and damn what it does to the rest of our game.

Dragging Celtic into this proceeding is more than just a convenience.

It’s a message, and one they want us to get loud and clear.

These people have nothing but contempt for the rules and for those of us who’re trying to see that they are followed correctly.

This shouldn’t surprise us; Regan himself has said, on the record, to a member of the Scottish Football Monitor site, that even if confronted with absolute proof of Rangers’ wrongdoing over Resolution 12 (and he has been, by the way) that he would do “nothing.”

Football administration?

Only in Scotland does it look like this.

Today they are brazenly rubbing our faces in it. Many of us are working on holding them to account, and Ashley seemed to offer one means of doing that. Today he’s dashed those hopes, and more besides. Aside from being an absolutely amoral scoundrel preying on sports fans all over the country, he comes out of this looking like a guy who’s hopelessly indecisive or completely gutless when it comes to the crunch.

I’m glad we weren’t waiting around for him to do this job for us.

But Celtic shareholders, take note.

These guys know you’re coming, and they’re getting ready for you.

back to football matters and it sounding more and more that Brendan Rodgers is our no1 target. if true i hope we can move fast get him appointed and announced after the hearts game and bring him in straight away……as long as we can win on saturday and i know thats me being hopeful, then there would be no reason for ronny to hang about and Brendan can start working on the team straight away

That bizarre statement by SFA laywers this morning in the Edinburgh Court of Sessions is a clear indication of how low they’ll stoop and tactics they plan to deploy in response to RES 12 – Paint all protests as the result of “internet bampots” and use anything they can think of to put the boot in and wriggle out of doing or saying anything.

Also expect the “confidential” / nothing to see here/move along (5th amendment-like) get out clause they used on “fit and proper” sham to be main line of their argument

i cant see Rodgers going back to Swansea, thats not a forward move in his career but taking the Celtic job ticks all the boxes for both parties. CL games and pumping the huns 4 times a year now that is very inviting plus he is Irish with Celtic in his heart….its a perfect match…..fingers crossed

Rebus on your question on clubs taking their association to court,don’t know if this answers it.
UEFA and FIFA regulations are very specific about how the clubs must do things in relation to the law. They must go through the governing bodies themselves, with CAS as a last resort. They cannot pursue legal channels out-with that, because UEFA and FIFA do not allow legal interference in the running of the game. Draconian punishments can handed down for doing so, including banning teams from Europe and stopping the national team from taking part in competition football.

These regulations do not cover individual actions by shareholders.

Thanks, Jimmy. I am not sure that groups of shareholders can raise actions with UEFA, nor am I sure that shareholders have access to CAS. I guess we shall find out if the Res 12 guys pursue this. I am not confident that the reply from SFA will spur the club into taking action. But how ludricous is the SFA ‘s response. It is over, so it is alright.!

Paul Lambert ticks many boxes as a prospective Manager at Celtic
He is very experienced in Europe as a player (70 games on the continent won the Champions League with Dortmund)
He knows the Club and is fully aware of the demands of the support and what it expects from the side.
He is experienced in Management at various levels
He knows the Market in England really well and will have contacts in that market
He is still only 46 and has many years of Management left in him
He is used to operating with different levels of Budgets and different demands at various Clubs
He won’t be phased by any player at Celtic as he has achieved more than any of them as a player so will command instant repsect as a result

i dont really like that john james sit on the fence zombie he knows the huns are corrupt but still says he is a supporter that makes him a hypocrite in my opinion but he wrote today that the real old firm is the zombies and the sfa and it was created before celtic were born he is right about that

I don’t think Rodgers will take it. He comes from a background of mixed faith. The Old firm baggage would be too much for him to cope with. I would love to see him here though.
Paul Lambert worked wonders at Wycombe, then Colchester then Norwich. He worked his socks off at Villa,and when he left they were 18th in the league, at Blackburn they have overwhelming debts of 102 million,and he gets no response from the owners who are based in India.
So I don’t get the negativity over Paul returning home.
He would be a good manager to have.

Spot on he has also achieved more as a player than any of the current squad so no more Egos to contend with.
