Celtic Diary Tuesday October 3: HMRC Make Their Move

Those who decided to use the unique tax system promoted at Ibrox in those heady days of creative accounting are about to find out that if something is too good to be true, then it isn’t true.

The tax free remuneration invoked by David Murray has been deemed by the Supreme Court not be be lawful, and HMRC, pausing only to stop laughing, are about to send out something called a follower notice to those who would have gotten away with it if it hadn’t been for those pesky policemen.

Still, at least none of them are stupid enough to go bankrupt and transfer their assets to their wife.

A follower notice, according to the HMRC website is this;

What to do if you’ve been involved in a tax avoidance scheme and receive a follower notice or accelerated payment notice from HMRC. 

Overview

If you’ve been involved in a tax avoidance scheme, you could receive a follower notice, accelerated payment notice (APN), or both from HM Revenue and Customs (HMRC).

The notice you receive will tell you what you need to do. Make sure you follow the steps in the notice, if you don’t, you may have to pay a penalty.

Follower notice

If you use a tax avoidance scheme that has the same or similar arrangements to one that HMRC has successfully challenged in court, HMRC will check your tax affairs and may send you a follower notice.

A follower notice asks you to settle your tax affairs with HMRC. If you don’t, you may have to pay a penalty.

As well as a follower notice, you may also receive an APN. If you do, you’ll need to pay the accelerated payment as well as settling your tax affairs.

Accelerated payment notice

You may receive an APN if there’s an enquiry, dispute or appeal in progress that relates to your tax affairs and you’ve either:

If you receive an APN, you must pay the amount of disputed tax. HMRC will hold this money until the enquiry into your affairs is complete, or your appeal is resolved. You’ll get the money back if HMRC finds you don’t owe it.

If you don’t pay the disputed tax amount by the date on the notice, you may have to pay a penalty.

Partner payment notice

If you’re a member of a partnership you’ll receive a partner payment notice (PPN) instead of an APN.

PPN usually works the same as an APN, but the individual notice you receive tells you exactly what you need to do.

What to do if you receive a notice

The notice you receive tells you:

  • why it’s been sent to you
  • what you need to do next
  • what to do if you disagree
  • any relevant deadlines
  • the penalties you may have to pay if you don’t take action

You should carry out the actions described in the individual notice you receive.

Penalties

If you don’t follow the steps described in a notice you receive, you may have to pay a penalty.

If this happens, you’ll receive a notice of penalty assessment telling you how much you have to pay, and by when. It also explains how the penalty is worked out.

Appeals

You can appeal against any penalties you receive from HMRC relating to follower notices, APNs or PPNs.

You can’t formally appeal against a notice you receive, but it does give you instructions on what to do if you disagree with it. 

Whilst those in receipt of one may be tempted to tell HMRC what they can do with it, that tactic is doomed to fail.

Thing is, these players took a chance on getting away with something, and they didn’t.

At this stage, they can still pass go, can still collect £200 and may not go directly to jail.

Though greed is a terrible crime, you have to feel a wee it sorry for them.

Footballers are not noted for being of above average intelligence, and they live in a cut throat world of business movers and shakers.

And crooks.

Thats why they employ agents -at enormous commissions-to do the moving and shaking for them.

Had I been advised to take an EBT, and assured that the side letters were of any use, my own agent would currently be locked in the garage with electrodes attached to his dangly bits while police negotiators haggled for his release.

So, who is going to be the first player to sue his agent for dropping him in the doodoo ?

As far as I can see, its a cast iron case, and would also have the happy outcome of agents getting a wee kick up the arse.

Something to think about…

 

Back at the ranch, and its international week, so there’s no real football to look forward to.

Meanwhile, the best fans in the world continue their campaign to make sure that any confidence new winger johnny Hayes gets from his manager, they will stamp on it and throw it out the back door.

Hayes has been at Celtic since the summer, and had earned the move with some excellent performances for Aberdeen. He’s finding his feet at his new club, and more often than not is finding them swept away by a support notorious for blaming wingers for all the ills of society.

Why do we always need someone to moan about ?

The strength in depth of the Celtic squad means that Hayes can afford to be given time to adjust to his new surroundings, he can be encouraged to settle in at his own pace. All fish eventually find their level to swim at when they are added to a bigger tank, and yet with Hayes there is an element in the support who want to let him flap about on the kitchen floor.

Efe ambrose could tell him a thing or two about our support. so could Aiden McGeady and James forrest.

Thats the key word, you see…”support ” . We are supporters.

How about cutting the guy some slack and giving him some support ?

We’ve a crucial month ahead of us. A double header with Bayern Munich, a league cup semi final and an Aberdeen side breathing down our necks at the top of the table.

We don’t need any of our players frightened to try anything in case the fans get on his back.

In fact, while we’re on the subject of helping people out…

And some people do need help..

Could Lionel Messi be mving to Manchester City ?

He certainly knows now what it feels like to play for them..

Flights and hotel now sorted for Munich , but match tickets may be an issue.

Said it before some supporters at Celtic park need to get to fuck.
It takes time to settle at Celtic,the guy ended up at left back on Saturday,the so called supporters should be ashamed of themselves in their treatment of players who are finding it difficult to settle in.
I bought a ticket so I will criticise brigade, need to have a long hard look at themselves or better still give their tickets to folk who can’t afford to go,but would love too.
I buy a ticket to watch the Celtic,the good and the bad.
Give the guy encouragement,your a supporter not a fuckin theatre critic.

Agree – nothing will hinder a player’s confidence more than audible sighs and torrents of abuse raining down from the stands every time a pass goes astray or he gets caught out of position. Whatever we may think of the quality of a player, whenever he wears the Hoops out on the pitch then we need to get right behind them and help them out with encouragement, not abuse. When Alan Thompson missed a penalty against Anderlecht, the reaction of the support was to cheer his name – that’s the kind of response we need when a player is having a bad day.

I’ve been going to Parkhead since the 60s,always heard some players getting stick from the fans,not abuse.Even Big Jock used to get criticism from the fans,as did Jinky and many others.It’s part and parcel of the game.My tickets are bought for £20 because that’s the system our club operates.As for hypocritical Monti,Boyata,Ambrose,severe abuse on here and about other players.I don’t boo Celtic players,never have,never will and I’ll not be getting to f.ck,charmer…..

I’m glad you haven’t booed Rob, like you I’ve seen the good and the bad and seen the treatment of players which beggars belief at times. Even my old man,had a grudge his was Tommy Callaghan,I swear if he could have got hold him he would have beaten him up. My response was to buy his picture from the ground,(remember you could but the pictures in a wee frame) and put it on the mantlepiece . Haha he loved that.
Yes as Ralph says the wingers through the years get it tight,from our supporters,but they need a little lovin not the abuse I hear around me inside the ground.
Like I said I would rather give encouragement and tend to clap and shout more,when a player is having a poor game ,much to the amusement of my grandson who thinks I’m crazy,but I try to get those around me to be positive.

We are of a like mind. I don’t shout at players, I join in the singing and try to lift the team. i don’t want to see a Celtic players head go down so I don’t get on their backs. By God, I’ve seen some crap through the years and still love Celtic. HH

You have to ask what some supporters want from the team at times, we can’t smash the opposition 5-0 in every game, we can’t be 3 up after 15 mins in every game.
There are games we will be lucky in, games we will sneak at the death, this is football.
We have a good team that is delivering big time, yet some think it’s some kind of disaster because we draw a game? Calm the fuck down, would like to see the support relax a bit and get right behind EVERY Celtic player, push the team on from the stands, it works.
We all have favourites & others where the jury is out all the time, this is normal.
However when that team in Hoops come out the tunnel we must get right behind ALL the players, frim the first whistle we must support and encourage.
Some of the support must get educated in the game, they have to understand that Saturday in the league, Wednesday in the Champions league & Saturday in the cup or league does place physical demands on the players, yet these Celtic players very rarely fail to deliver the goods.
If a treble, two Champions league group stage campaigns and a real prospect of another siver laden season isn’t enough for some then give me your fucking ticket and i’ll go every week, and if you have ever sat next to me at the football, i’ll do your fucking head in, because i sing, kick every ball and get behind Celtic for 90 mins!

Great comment Monti. From the 8th September we played 7 games in 22 days of that month. Won 5 drew 1 lost 1. We lost to the most expensive team ever assembled in club football. We won an away match 3-0 in the CL Groups. We progressed away from home in the League Cup and we strolled it away to so-called rangers giving our fans even more joy by humiliating the same flies from a different shit shower. Hibs played really well against us and I felt a draw was fair; 4 cracking goals, some great saves and some great football. I enjoyed the game and had no complaints. I feel that Celtic are giving me almost everything I could ask for. I’m delighted to be a Tim, day and daily.

Don’t agree with screaming and shouting at players at the game as it never makes them play any better. However, criticising the players in the pub or in any discussions is allowed surely. Football is very emotive, therefore people will have different opinions. In my opinion buying him was a mistake because he is not good enough. It was a strange decision. Regardless of how long he us at Celtic he will never be good enough and will be gone next summer if not in January. He is reaching the end of his career and is not going to get any better than he is. But in the current ‘we all think exactly the same’ world of Celtic, individuals are no longer able to express their views. We must all think the same. This is very poor. Very Sevco.

John no one disputes the right of any supporter to discuss the good and the bad. But the supporters who constantly moan,and groan,and I have plenty around me,need to get a grip.
This is the best Celtic side I have seen since the big bucks were spent on the Martin ONeil days. Yes by all means moan like fuck with one another on the way home from games,on here or in the pubs or as we do on our supporters bus coming home,,but inside the ground,give your all to support the players and if you can’t just sit quietly,no need to shout abuse to a player whose only crime is trying to do his best.
Fuck sevco couldn’t care less about them.

For me its a case of having a SPL team and a European team – some will be ever presents like KT who is naturally fit and not injury prone (bar elbows) – however some – particularly wingers and older players (like Brown) will need rested. I’d love 11 of the standard of Sinclair but we can’t get players at that level.

After the international break, Celtic have six fixtures in the space of 17 days, Jozo could be ruled out of some if not all of these games if the tear is serious.

Recovery time can vary from a couple of weeks to months.

Jozo’s news is bad, it would be interesting to find out how often he has been out injured, how many games he has played in relation to how many he could have played, a good player, but surely we must be looking for another centre back in January.

Jozo has missed 45 games over two seasons, not including the current one. When we signed him he went straight on to the injured list. I think Zagreb say us coming and that is why they were prepared to take a smaller fee initially but built in a sell-on clause.

I think he needs to be replaced and that we move him on when possible.

I agree, it does not matter how good a player you are if you are constantly injured your absence in the team and then your reappearance continually disrupts the team flow. Since the MON era we have not had two good centre-backs, good enough for week on week duties.
They are not the most expensive players in a team so we need to get one in soon. A robust centre-back good in the air and physically strong, it does not matter that he is a great passer, after all the passes from the back are only short distances.

How can anyone on here claim to know better than B Rodgers . If his ( the posters) opinion is worth considering , then it is time to sack Rodgers .
The loud sighers & moaner & those among our fans who shout abuse at certain players buy their tickets under false pretences. Celtic fans are supporters who by definition encourage our players & manager .
The only time Brendan has spoken about leaving , he said when fans told him . Surely when a so called fan puts his opinion up against Brendan , it is giving him a message . If we don’t support his team , that’s the same .
To say just because Celtic fans shouted & abused Celtic Manager& players in the 60’s & 70’s is no excuse . We are meant to be a better educated society nowadays

I remember hearing Ruud Guillit once talk about footballers, and salaries and transfers – what most players want to know about is what he called “netto” what will I have take home after deductions?
Most players don’t care how the money is sourced or what deductions their employers have to pay, they want to know their net take home, and that’s it
So you can see why EBTs appealed to Rangers – reduce the gross required to pay the net
Some players and their agents it seemed asked no questions and signed up right away, others were more cautious and some even asked for indemnity letters – that in the case of the tax man ever coming looking for this money the “club” would cover the debt.

So you can see why this has the potential to get interesting – who is sitting on such letters, will they present them when the bill lands on the door mat, will they be able to get *rangers to engage with them, will they end up using the courts to try to get *rangers to acknowledge the debts they feel rangers owe them – it could see *rangers appointed lawyers argue in court they are a new club with no connection to the old rangers who made these promises, or try to make it a Murray group issue – raising the question of 3rd party ownership of player registration and therefore making LNS an even more limp exercise in cleansing the game

If I had such a letter promising me I would be liable for nothing should the scheme ever go t*ts up, I d be straight onto a good lawyer.
The possibilities of their 9iar heroes arguing in court rangers /*rangers are the same organisation while *rangers QCs deny it could cause much much hilarity and soul searching among ra bears, if indeed they have souls, having to come out and defend a new club stance after 5 years of insisting they weren’t

I also have witnessed celtic supporters hand out non stop abuse to our own players through the years. Really vitriolic and nasty. I always wondered why these dick heads even come to games as they are never happy and intent on giving our players dogs abuse. Maybe they should stay at home and get some anger management therapy

With the tax people out to recover taxes owed from EBTs, I think we will see more pressure on the SFA who were either duped by oldco or were part of the EBT scam. It will become apparent that these players who will be asked to pay back tax will also have their player registration examined to confirm they were playing legally within the rules. This is ongoing and the truth will come out especially when these EBT recipients including Murray are held to account by Her Majesty’s Revenue.

I like watching the game and try to watch a player as well.Gives you a sense of where they are at and what they are doing individually and for the team. It was evident that Hayes was initially told to take on Whittaker and he did well in this. Hibs ,not having a mug for a manager, worked this out and kept Mc Geough in front of him so mid way through the first half he walked the line but often cut it back, keeping possession better than trying to take two on. I have never voiced a negative opinion about a Celt at a game( not least due to always having weans with me) and there wasn’t any around me in 114 or in the rest of the stadium who did.I sigh inwardly at times and got agitated inwardly(particularly at Edouardeon Saturday) but that is more than compensated by the football we are playing which 8 minutes on Sportscene don’t show) Mc Ginn is a good Scottish player…but so was Scott Allan.

I have never booed a Celtic player. My job is to support our team, not tear it down. Jonny Hayes will come good, he needs time. Not so long ago many on this forum had no time for Broonie or James Forrest either.
