Celtic Diary Friday September 8: Res12 The Beginning of the End

The decision to reproduce the 2012 letter from Peter Lawwell to Stewart Regan in yesterdays London Times was quite a surprise, and has prompted a few questions.

This is the letter..

Another letter, this time from the SPFL’s Neil Doncaster was sent in July of this year. We know that the SFA met a week or so after receiving it to discuss it, but it was yesterday before a reply was given.

Doncaster wanted the SFA to participate in a review…

To which the SFA hurriedly replied yesterday…

Thats where we’re up to.

But this sudden, almost frenzied release of correspondence throws up a number of questions…

Going back, first of all, to the Times article..

Who gave them the letter ? 

Apart from Lawwell,there are four possibilities. Look at who got the original. Topping, Longmuir, Infantino and of course, Regan.

It’s highly unlikely Infantino knows where his copy is by now, and Longmuir and Topping have distanced themselves from the whole issue.

Regan ?

If it had been him, he would not have given it to a London paper, he has fallen out of favour with the Scottish media, but would still be able to manipulate the story a little to make it appear as though its still a Celtic Rangers issue, and of no concern to anyone else.

That leaves Lawwell…

Why would he give it to them ?

By giving it to a London paper, he ensures a degree of control in how it is presented, and it means that a much wider audience, which may still be unaware or correctly advised of the issue becomes aware.

Especially his colleagues at the Eurpoean Club Association, who he may need a good word from should UEFA become involved at a later date. After all, UEFA would ask the Scottish guys at UEFA what its all about, and they may not be entirely truthful in their replies, especially as they are central to any review.

Why now ? 

Perhaps he was just trying to get a response to the Doncaster letter, which seems to have been taking a while for Regan to er, compose.

If thats the case, it worked. Regan must have been screaming to his secretary to type quicker as he dictated his attempt at damage control.

Is the Doncaster letter of any significance, or is he just going through the motions ? 

It’s entirely possible that Doncasters request for the SFA to participate in a judicial review is merely paying lip service to Lawwell. He could just be covering his own tracks by asking, and then , having been told no, he may well try to say thats the end of the matter.

If that is the case, then he will be hung out to dry with Regan and his cronies, and one or two club chairmen will be facing the wrath of their support.

However, Doncaster wrote that letter on behalf of the 42 league clubs. He will have had to solicit approval.

Doncaster only does what the clubs want him to do, or to say.

His last attempt to draw a line under events failed miserably, with an attendant lawyer he only succeeded in further muddying the waters, and making the SPFL appear just as guilty as the SFA.

This would not have been what the clubs wanted. There’s little doubt they would all rather move on, but it must be coming clear to them now that they will not be allowed to.

Hence Doncaster acting on their behalf by asking Regan if he’d like to take part in a review .

What will be reviewed ? 

It says at the top of his letter they want to review Tax Avoidance schemes at Rangers and the actions of Scottish football authorities, which presumably includes the SPFL as well as the SFA.

Again, there is a danger the whole thing will be a whitewash, and had Regan consented to take part, there was a line about “records ” at both offices that could be useful.

Surely if no one has anything to hide, they would all welcome the chance to get everything into the open so we can all move on ?

If, however , Doncaster, acting on behalf of the clubs, is genuine, this is probably the most significant development to date on the issue.

Note the review will cover tax avoidance schemes at Rangers. Nowhere else, and this has nothing to do with any other club.

It will cover the actions of the authorities.

This suggests that its not about title stripping, which the press would have you believe, and its not about Celtic and Rangers, as they too would prefer we thought.

Its about the tax dodging, and one would hope that improperly registered players is included in that remit, as it overlaps with the actions of the authorities.

We need to move away from the title stripping narrative, and onto the question of the way the authorities acted.

We need to know who presented the registrations to the SFA, and who accepted them.

By expanding on that theme, we also have to ask, and here’s where Resolution 12 and smoking guns come into play, who at the SFA submitted the information on the crystallised “wee tax debt ” to UEFA, and who at UEFA accepted it ?

Which, as we know, was crucial in granting a licence to play in the champions League for the old Ibrox club.

As far back as 2009, the SFA were aware of financial irregularities at the Ibrox club..

The third party was …HMRC.

Why did no one at the SFA ask HMRC what it was all about ?

Why weren’t the press on it immediately ?

Even back then, were they hoping it would all go away ?

Had the London police not found some papers relating to the Boumsong transfer-where a former Rangers employee paid a huge transfer fee to buy him from the club for his new employers-then it might well have done.

 

Why has Regan declined to take part in a review ? 

One can only speculate, but my guess is he, and his SFA cronies, are as guilty as the proverbial puppy sitting next to a pile of poo.

Whats also interesting is the use of language in his reply.

He doesn’t decline the offer on the basis of a lack of evidence, whether new or old.

He declines it to avoid further damage to the game, which means he accepts the game has been damaged, by the tax avoidance scheme and the actions of Scottish football authorities, yet has no wish to “rake over the coals ”

Raking over the coals means

to talk about unpleasant things from the past that other people would prefer not to talk about 

Not to be confused with hauling over the coals, which was used in the middle ages to ensure those who had doubts about their faith, heretics, would find it easier to remove those doubts.

Does this mean that Regan doesn;t want to talk about them any more ?

Or Campbel Ogilvie, or Andrew Dickson, or indeed do any of thise involved not want to talk about it any more ?

Ogilvie was central to all of this, and Dickson may well have been.

Though he struggles to remember, as we saw in 2011 at the First Tier Tax tribunal.. when he was asked about the removal of side letters…

You would think all of the characters in this story would welcome a chance to clear their names, and er, move on…

Well, I would.

 

Thats where we’re up to, but whats it all about ?

Wheres it all heading ?

This is where we can only speculate.

We are now all aware that Lawwell has been acting in the best interests of the club. I was already aware, but did ask him if he felt he could maybe keep reminding us if that.

Well, he has now. That for sure.

The original letter to Regan is five years old.

During that period a lot has happened.

We now know that the tax avoidance scheme was illegal.

We now know that players were improperly registered.

We now know that there can be no more stalling by those we are suggesting were compliant or incompetent.

Thats why the second letter was sent , and Regan, it appears, was kind of hoping Lawwell had forgotten about it.

The times article looks like a statement of intent from Celtic, and Regan, panicking a little, seems to be pleading with his old chum Doncaster to drop it, to remember who is pals are.

Maybe its even a veiled threat to Doncaster that he, too, would prefer not to talk about those events, as perhaps there is evidence he was complicit…

Doncaster, however, acts on behalf of the clubs, and that will be his defence.

The clubs, remember, bar a noble few, may well have accepted the new Rangers into the First Division, or even the Premier League, but the supporters were having none of it, and men like Turnbull Hutton made certain it didn’t happen.

what we may be seeing here are the first shots in a battle for control of Scottish football.

A battle that has been coming for a while.

On the one side we have the SFA, who are unregulated, unaccountable and lack transparency.

On the other, we have the SPFL, backed by the clubs, who will do the bidding of their support.

What happens if the SPFL hold an independent review without the participation of the SFA

Could they call the SFA board in for questioning ? Could they demand answers ?

If Regan and his cronies fail to appear, could the SPFL, or the Gaming Board of the SFA-we’re back to Lawwell again-actually call for a vote of no confidence in the board of the SFA ?

With Doncaster acting for the clubs with his request for SFA particpation, we could assume support for such a motion is already there.

Could we indeed, be witnessing the advent of Armageddon, but not the one envisaged by Regan back in the day ?

I sincerely hope so.

It is a mystery ,

but as I said in my post to john (below) , irrelevant to who instigated the leak , the issue is now “front page” , and the real point of focus must now be the consequences.
I know we’re (Celtic) up against a lot here , but can’t believe THEY have the capability to out-think the likes of DD/PL . Whatever anybody’s opinion on these guys , they are big hitters ,and don’t lose many.
I think this all may come down to how much Celtic want this ; if they want it enough they’ll get it.

It seems that far from this coming to a conclusion it is about to take off. The bit that annoys me isn’t Regan, Doncaster, Murray or Ogilvie, people will do what they do out of self interest, always have always will.
It is the hypocrites of Scottish journalism who are straight into any official or corporate cover ups like rats up a drain pipe( or is it down). They are key players in any conspiracy, for whatever reason they cannot address this issue they they would if it was a Govt. minister, a Lical Authority , a banker or doctor who broke the rules and then covered up. Shame on the Scottish sports media, such cowards.

HMRC The Freedom of Information officer is Mr. Mike Potter, the Chief Digital and Information Officer. Because they are a public body they must respond to any approach for information. They might/should have information relating to the SFA/SPFL with regards to the “Rangers Tax Case.
Regan hiding along with his board, which consists of—-

Stewart Regan,
Rod Petrie,
Tom Johnston,
Ralph Topping,
Michael Mulraney, (went to school with his sister).
Barrie Jackson,
Garry Hughes.
By granting a license to “Rangers” in 2011, who played against Malmo, they defrauded Celtic of C.L. money, this should never be forgotten, as I have said many times before this was fraud.

It is that unseen Fenian hand again, this had to be have been leaked to the London Times by Lawwell with the Celtic Board’s approval, he is no lone gunman, excuse the pun.
Who blinks first will be interesting, once the balance of power shifts/has shifted to the good guys then the rats will make a move all about self protection, there’s always someone prepared to sing like a canary if it means self preservation!

But there only appears to be two letters in the past 5 and a half years. It does not sound like a committed attempt to get justice. It sounds as if Big Peter leaks things to appease a support who will believe most of the guff that comes out of Celtic Park. Why has Lawwell not demanded action and called it what it is fraud and cheating. Why was it not done over 5 years ago. Why does Lawwell not threaten legal action for lost income. Does he not have a fiduciary responsibility to share-holders to protect their interests Why now? He has received a lot of criticism recently for his lack of urgency in strengthening the defence. Maybe this is the squirrel to deflect from a possibly damaging CL campaign. Too little too late

A good Tim like you should be glad he has at least manoeuvred himself into prime position for as and when the shite really hits the SFA fan.
It is my opinion that Peter Lawwell will leave Celtic at some point in the near future to further his career at the very top of the European game.
It is also my opinion that he will cut the nuts off all those implicated in this charade before he goes.
He’s a Celtic man at heart but he’s a business man in the head and I now believe he has played the long game and waited till the line was drawn under the legal side of what went on?
For all the shite he gets he’s still there and he’s THE ONLY ONE with the balls to take these cunts on.
You should be glad that he is.
But then my guess is it’s probably your worst nightmare that he will?

Celtic is the superpower in Scotland now these cunts have no chance.

Listen John. I am and never have been a lover of Peter Lawwell. Though I think what he does on the day to day running of Celtic, he does probably better than any single man does or would be capable of doing. You suggest he should call them out and demand this and that. Would you? Would you be happy to have your life and that of your family put at risk? That’s the kind of thing you’ve got to assess in dealing with this matter. You need to think things through before berating all and sundry.

I am convinced that if you won a million on the lottery, you would be disappointed because it is not two million.

You need to shape up and recognise that the Lawell letter shows that Celtic did something about both the Rangers licence and the ebt implications years ago. Further the evidence of this letter shows that Celtic were acting on these issues but not seeking publicity over their actions. Slowly, slowly, catchee monkey! The Board took a lot of public heat over their perceived lack of action, but here we see that they did do something and were slowly building the case against the SFA.

All opinions are welcome on here and most are just as good as any other, but you need to come up with something that is not negative once in a while. After reading your latest piece, I wonder why you continue to support the club? Do you get pleasure from pessimism?

“Big Peter” as you call him did NOT leak the letter , nor did Celtic.
CQN , Celtic Blog etc have all accepted this.

Whatever the intention the SFA (using Broadfoot) had for doing so ; my guess is it was a bad miscalculation on their part .

Apart from angering Celtic (remember the 2016 SC semi final and the consequences of that ; i.e.Brendan and an invincible treble), all they have done is bring the whole issue “front and centre”.
Not a smart move to give a subject blazing publicity , if you’re hoping it will just go away ( move on).

I believe they’ll soon regret this latest Machiavellian move.

The time has arrived to turn the pressure gauge on the SFA & SPFL to maximum levels.
The SFA under no circumstances must be allowed to airbrush their way through the game, they have caused irreparable damage to Scottish football, what we have here as a game is nothing but a dark , shadowy, secretive corrupt game, the SFA has to be disbanded, a wrecking ball taken to it.

Ralph, excellent. Your main point is a killer: were players improperly registered? If so, what are the penalties for improper registration? This then becomes simple and there must be a lot of precedence for improperly registered players in Scotland, England and UEFA generally. Therefore, punishment should be based on precedent. Illegal players, yes or no?

Hun believably the same cheats are still involved in running the game at the SFA “Rangers” and UEFA, still taking money out of the (spit) beautiful game, brass necks do not do them justice. Proven in a court of law to be liars, cheats and criminals.
How can this be? just add a compliant press and national broadcaster and STV. You get this perfect storm when an honest press aids and abets a national association to cheat and defraud.
If our board does not act on this then it aids criminality and by association tars us with the same brush.
We cannot must not let this happen,

To those who find it hard or impossie to believe Celtic are acting positively.

Celtic are the other club who wrote independently to the SFA (about 8 weeks ago?) That is mentioned in SFA response.

That followed the SFA announcement on 5th July when the SC ruled on ebts.

The advice given to Celtic last December when Res12 was passed over to them was to wait for both court cases on ebts and Craig Whyte to end. The latter case was followed closely by a number of interested parties in football.

From then Celtic have made their current position clear and presented a case that has resulted in the UEFA licence of 2011 being put before the Compliance Officer and no one knows what that outcome will be based on the evidence that has clearly been given the once over by an SFA QC.

There is no doubt the status of the wtc liability was misrepresented by Rangers on 1st April which allowed the Licence to be granted on 19th April 2011.

There is no doubt the status continued to be misrepresented in subsequent submissions by RFC under Art66 and Art 67 of UEFA FFP.

What is uncertain is the role those working at Hampden either as Commitee members or officials played to keep UEFA at bay.

E mails of Sept and the well known one of December from Regan, the day after he spoke to Andrew Dickson about the Licence issue, require questions to be answered, for example why did the Ramsay chap think publishing Regan’s statement might cause SFA problems?

Finally what was Regan and Ogilvie told in the meeting that did result from his e mail at the Hotel de Ville?

What was he told that satisfied him nothing should be published which dictated SFA policy on UEFA licence thereafter?

So Celtic took on board the advice to wait and have very much acted after 5th July on Res12. It was always going to be so.

There is an AGM in a few months and the club are accountable to shareholders but it must be obvious by now they are dealing with folk of no integrity whatsoever who are prepared to lie or conceal as a matter of course.

Neither the SFA nor the SPL can institute a “judicial review” or a “judicial inquiry”. Only governments can do either. What they can do is hire a retired judge or a high profile QC to conduct an “independent inquiry”. I wonder if Donald is busy?

You. I and everyone else in football are in a fortunate position to love the Glasgow Celtic. Celtic is our lives it’s an incredible force that has proved to overcome adversity shonky committees and managers and players in the past. That’s history now there’s now an unprecedented platform in the modern game to achieve and maybe flatter to deceive. Our unequivocal situation makes us a very lucky set of supporters

Good on him. It appears we tried to proceed this story by the book until the point it became totally clear the SFA would just keep sweeping under the carpet.

From the SFA point of view it makes sense to not rake over the coals. After all, having swept everything under the carpet, raking them again could cause a fire to start which could burn everything down

For normal folk it feels finally like some bricks in the facade are getting knocked out and I’m more hopeful than for some time LNS may not be the final word on all this

What have we learned today,

Well we learned that it was not Celtic who leaked the letter to the Times, but irrespective of who the individual was, it must have been sanctioned by Regan, he was the organ grinder.
But for me it was reassuring to find out that Lawwell had indeed acted on behalf of the Celtic board to request action be taking against the cheating liars at the old co and there puppets at the SFA. It sounds like some misjudged him/them, perhaps to suit there own agenda, they are certainly not perfect, but who is?
It was also reassuring that Doncaster and the SPFL requested that the SFA hold an judicial review into the SFA’s governance of the game.
It also seems to suggest that there is no willingness from the other major clubs to investigate further, but that is the chairmen not necessarily the supporters.
I really hope that the board take this much further and that a judicial review is carried out to bring out all the dirty linen, only then can the beautiful game in Scotia. achieve the fairness, openness and transparency that is needed.

The whole system in this country is corrupt. Fergus proved it years ago with Farry. Jock bullied them into submission, but still like the living deid they rise. From the hateful sectarian bed.
When a Celric fan is caught with a pro RA tea shirt on, prosecutions follow. Fifty thousand from all classes, sing various ditties at Ibrokes, what happens.
For years Celtic have operated with one hand tied behind their back, Fergus forced them to be nervous. Now Lawell should threaten financial compensation for the period that Celtic did not qualify for the UCL, if none forthcoming challenge the SFA in the courts, a bot of cash, but this would be well spent to clear out the Augeian stables.
Glad the really footie is back.
