Celtic Diary Thursday December 1: Resolution 12: No Excuses For Board

The Resolution 12 lads due to meet Celtic directors this month. A short meeting took place last week to mainly discuss process, but the big one is in December.

They will discuss how to move forward  on the issue of the SFA granting a licence to a club which had not met the UEFA requirements for one.

The Scottish media may well have entered the fray by beginning their own rival campaign, which if successful, would see the SFA grant a licence to a club which has not met the requirements for one.

History repeating itself ? Possibly..

 

It began yesterday when STV, the mainstream television company which is a partner of the club which may have difficulty in gaining a licence to play in European competition, sought to put to rest the minds of the clubs support.

Explained: Will Rangers need UEFA approval to play in Europe? 

The article was put together by Grant Russell, who in the past has claimed to receive a virtually verbatim response to his questions to UEFA re the accusations that  SFA malpractice  that led to a club being falsely granted a licence to play in the Champions League.

Russell, incidentally, has never reproduced publicly either those questions or an answer addressed solely to him, which leads one to suspect he’s not being entirely truthful about where and how he claims to have got them.

On this site, all questions from the Resolution 12 lads and all answers from UEFA were reproduced.

Russells article begins…

Reports suggest the governing body will need to give dispensation to the Ibrox club if they qualify.  

“Suggest”…”if.”…two key words.

And they” need ”  to ?  who ?

Who says governing body  “need ” to do anything ? Except uphold the rules ?

 

Interestingly, he says the governing body will need to give dispensation to the Ibrox club. Lets assume he meant this as a note on procedure, and not to avoid “social unrest “, though the implication is there.

Technically, that is not correct. UEFA do not deal directly with clubs on this issue, only with associations.

Which is where pressure will be placed to bend, twist and thoroughly misshape the rules.

Rangers’ failure to secure a crucial AGM vote allowing them to issue new shares could have a knock-on effect should they qualify for Europe in the near future. 

Was this the purpose of the vote ? To raise capital to convert into equity to sidestep the FFP rules ? Or was it to raise money simply to keep the club going until they can raise alternative investment. Of course, the report doesn’t ask, or clarify, or even mention it again.

UEFA rules on financial fair play could apply to the club because of the scale of financial losses they have reported. 

Could ?

With directors and other related parties having provided upwards of £13m in loans to keep Rangers afloat, being able to convert their cash into shares would have helped meet the criteria.  

So we can assume that was the plan, especially after other reports blamed former golden boy Ally McCoist, who didn’t vote at all and thus caused the vote to fail. Not that that should matter, as the Ibrox club and its owners have only a fleeting relationship with the rules the rest of us live by, and after a recount, one would not be surprised to see that they won their vote anyway, and Mrs. Urquhart, who did the counting, is very sorry but she mislaid some when her pal rang and asked her if she wanted to go to the bingo.

 

Those hopes were dashed in a vote lost by just 0.4%. 

Which, if true, is a good reason to start that count.

As a result, newspaper reports on Wednesday state Rangers will need “special dispensation” from European football’s governing body to play in continental competition, should they qualify in the 2017/18 season. 

To qualify for Europe, based on performances thus far, won’t only need special dispensation, but divine intervention. but even this early, they need to have something to hope for, otherwise they’ll stop going to games, and that would accelerate the end game.

So how serious is this position for Rangers? We’ve gone through UEFA’s financial fair play regulations to establish the facts. 

What do UEFA’s rules say?

In a nutshell, regulations are in place to deter clubs from running up significant financial losses.

This is done for two reasons. First, to try to protect teams from themselves. Secondly, to ensure competition is not distorted by clubs being able to run up huge debt while continuing to use that debt to fund football success. 

Distortion such as clubs running up huge debts to pay for players they cannot afford, for instance.

He missed out a third. To stop cheats. Clubs who have form for buying players they cannot afford , running up huge debts and then liquidating and starting again as though nothing had happened.

Clubs are allowed to post a maximum aggregate loss over every three-year “monitoring period” of €5m (£4.25m at today’s rates). 

Failure to contain losses to under this amount can result in sanctions, with some exceptions. 

As you are aware, this amount is considerably less than current aggregate losses at Ibrox. With no revenue stream available to even suggest this is merely a temporary state of affairs, we can safely say that this situation isn’t going to change. Unless, of course, owner operator Dave king pays the debt off. King has paid debts off before, but only when threatened with a jail sentence.

But, of course, these facts are kind of left to one side for the purpose of this article.

How big are Rangers’ losses?

For the period relevant to the 2017/18 season, UEFA looks at the financial reporting years of 2017, 2016 and 2015.

Rangers’ accounts for the financial year ending June 2017 will not be published until later next year so it is not possible to establish what profit or loss they will post. 

We will get some indication from interim results posted in early to mid-2017.

The early signs are Rangers are going to run into difficulty. Their aggregate losses to date are £11.9m, well above the threshold. 

“are going to run into difficulty ? ” They’ve just tried to raise money via an unregulated share issue without specifying a reason, and failed. Thats not just an “early sign “, thats a “fucking hell has anyone got any money we can borrow we’re really in the shit and everyone knows it.

Thats important. Everyone knows that they have failed to raise emergency funds which would not be paid back, but converted into shares. The curious thing is that with King on board, who would cause even the most frivolous of investors to pause, it does seem unrealistic that they would have raised the money anyway.

But they have to look like they would, and a dignified failure to get permission, with a handy scapegoat, looks an awful lot better than a failed share issue. Especially when the SFA have to plead the case of the Ibrox club to UEFA.

Again, this conclusion, granted only my opinion, is ignored.

What do Rangers need to do between now and 2017/18?

If posting a profit to level out losses isn’t achievable, there are two simple ways to fall in line. 

Simple ? In the same way that it would be simple for me to organise a night of rumbustious tomfoolery with a dozen cheerleaders and a couple of hollywood actresses, presumably.

Having lost the vote on the share issue by such a fine margin, the club could look to call it again. If it passes, it would pave the way for a cash injection into the club which could balance out losses. 

This could be done by calling an extraordinary general meeting.

UEFA allows a maximum of £23.6m to be written off over a three-year period in this manner. 

So, to prove that the club is adhering to Financial Fair Play rules, those who are owed money will be asked to waive their right to be repaid. Well, fair enough, its an improvement. At least they are going to ask them this time, and not just shut the place down and run off with the few bits that are worth anything.

Those who have provided loans could also simply turn benefactors and write off their loans as donations – a highly unlikely course of action but one that is allowed under the regulations. 

There’s a compound of that word again-simple. Note how the whole issue is being played down, yet at the same time firmly registered into the hearts and minds of the Ibrox support, awaiting the final nod as to who is to blame when it all goes tits up again.

David Murrays five years up yet ? Could he ride into town and offer his not inconsiderable financial support ?

If Rangers fail to meet the criteria, will they be banned from playing in Europe?

No. Not in season 2017/18. 

UEFA begins to monitor under the “break-even requirement” at the point a licence is applied for but no club has ever been banned prior to competition for failing to meet the criteria.

Decisions on PAS Giannina and Panathinaikos

Published: Thursday 27 June 2013, 12.17CET
The UEFA Club Financial Control Body, following a meeting of its adjudicatory chamber, decided not to admit PAS Giannina FC and Panathinaikos FC to the 2013/14 UEFA Europa League.

The UEFA Club Financial Control Body (CFCB), further to the investigation performed earlier this June and after the meeting of its adjudicatory chamber in Nyon, Switzerland, has taken decisions with regard to the two Greek clubs PAS Giannina FC and Panathinaikos FC.

The CFCB has concluded that the licence awarded to both clubs by the national association to participate in the UEFA club competitions was not issued in accordance with the UEFA Club Licensing and Financial Fair Play Regulations (Edition 2012) due to the non-fulfilment of financial criteria.

Therefore, PAS Giannina FC, who were entitled to enter the 2013/14 UEFA Europa League on sporting merit, and Panathinaikos FC, who as the next best-placed club would be first considered to replace PAS Giannina FC, have both been refused the admission to this season’s competition.

These decisions are final and may be appealed before the Court of Arbitration for Sport.  

Giannina had overdue payables.

So, what actually is the purpose of this particular piece, which appeared yesterday on STV’s website ?

Simple, somehow it has become imperative for the SFA to grant a licence to the Ibrox club to participate in Europe next season. Disregard for a moment whether or not they will qualify.

After all, they bent over backwards before, it seems, so why not again.

This article, and no doubt others to follow, are part of a campaign to give the Ibrox club help, help that they are not entitled to, to get into European competition at the expense of another club, who would equally appreciate the income.

This attempted lifeline must be cut off immediately.

If the club meet all requirements to participate, then fine. It does not look like they are going to.

Now, as we are aware, the Resolution 12 guys are meeting with Iain Bankier, and perhaps others on the Celtic board. Celtic, of course, were the last club to lose a considerable sum of money due to alleged malpractice at the SFA. There were others as well.

When the guys sit down in front of the board, I wonder if I could ask them to remind Mr. Bankier of what he said at the AGM regarding shareholder and supporter concern at possible malpractice at the SFA

  This is an important matter of governance relating to the football authorities and the Club will continue to work with its shareholders in this regard.

 Does Bankier mean what he said ? Is he going to do the right thing ? 

If Celtic do not now ask questions,and demand actions and answers,  there is a real danger that not only will the SFA feel they have got away with cheating, as one can only assume their reluctance to answer questions is because they have something to hide, the real danger is that they will do it all over again next year.

If they got away with it then, you can be assured they will try to do it again.

Celtic have no choice but to raise shareholder concerns at UEFA and ask for an investigation.

That time is now.

There is no way that the SFA will grant a licence to the mankies,they are aware that the Res.12 Bhoys and the Celtic Board are watching everything that!s going on.
They got away with it last time because the other clubs including our own knew nothing of what was going on,it was only down to the intelligence and the suspicions of the Res. 12 bhoys that brought this out into the mainstream support.
Do you think for a moment that the Directors at Hearts or Aberdeen will just roll over and have there tummies tickled and lose out on European monies,no way they will,everybody and there grannies are aware of this cheating and will fight it tooth and nail.
Keep up the good fight,keep on making us aware of the cheating,its down to bhoys like you and the Res.12 Bhoys to keep this issue mainstream.

Do you never sleep? Mind you, this subject would keep you awake all night. It is an absolute nightmare. I know Aberdeen and Hearts – and perhaps others – would most likely not stand by idly and accept any future shenanigans, but it is the silence about the past that really gets to me. If Res12 is proved to be right, then the sporting ethic of Scottish football has been distorted for a long time. This should create as bug an outcry as the potential for future “maladministration”. Time for you to read some of your poetry at Tannadice and Dens. That would move them! Let me know. I might take a trip up and have a picnic as in days of yore 🙂

Celtic were offered the opportunity to use EBT’s at the same time as ‘them’, from the porstar. It only became relevant in 2005 with Juninho and his side lettered EBT. The then Board of Director ‘KNEW’ RFC Plc (IL) were cheating ‘everybody’ since at least 2005 and they said or done ‘NOTHING’. You can even forget about the Big Tax Case as ‘thems’ conceded that the week tax case was deliberate tax avoidance. HH

EBTs have been around since the late eighties,used by many high earners,they were not deemed illegal,only a tax avoidance scheme.
It was not our Boards responsibility to interfere with other fitba clubs administration,we obviously deemed it risky and because of good governance decided not to use it.
It will be interesting to find out how Hector prevails in the up coming tax trials.

There is no evidence anywhere that BDO have actually applied to the supreme court for a review, that 3 Law Lord had previously decided the case was “self evident” and “common sense”. If the Celtic Board members ‘believe’ that it didn’t fall under their remit to inform the HMRC, SPFL and the SFA of a level of unparalleled ‘cheating’ that has never been the like of before. Well that’s on them then. EBT=Evasion it’s that simple to, not to even mention side letters for and the DOS EBT, they got caught funnily enough, ‘red handed’ and admitted liability for it, then quickly forgot about it again from the share purchase agreement. 😉 HH

Excellent! Real street talk, not bullshit. These issues have been pussyfooted around and dressed up by so often that those who want to will be tempted to believe it is all simply Celtic Fans’ paranoia. What makes it not so? Facts, pure and simple, FACTS! Without the veneer and the trimmings it is a huge dereliction of duty, at the very least, or downright fraudulent administration, more likely.

The Celtic board must now act positively and take the necessary steps to support Res12. Not to do so would be to co-conspire; to neglect the very duty the chairman boasted about; to destroy any remaining trust between board and supporters and to challenge, as never before, many supporters’ affiliations. However, though it is the role of our support to take our board to task as we are currently doing, I am convinced it is not helped by the apparent lack of public interest among the vast majority of other clubs – I accept there are a couple of standing in the wings just waiting for the cue to react. Every club in the country, large, small or tiny, is affected by this unresolved dispute simply because no Scottish football will ever be a fair sporting competition if this potential bias is allowed to continue. If it accepted at one level, then the door is wide open for it to be so everywhere. So, would I be correct in saying our cause would be greatly enhanced if these other clubs at least indicated whre they stand and how they would react? The excrutiating sound of silence!

PB, I totally agree with everything Ralph said and what you and others have commented. Apart from all that, if the SFA get away with this what right would they have to quote the football rule book in years to come when deciding on punishment/action/arbitration with the clubs involved? Where would their “credibility” be? We don’t take advice about personal safety from serial killers. The cat is out the bag and they are desperately trying to stuff it back in before its miaowing attracts the attention/scrutiny of the high powers at UEFA. They know that if UEFA get really involved then the BBC, STV, Daily Rancid, Jabba the Hun, the Ibrox Evening Times etc, will be totally impotent. Don’t forget, the real reason the Ibrox club ended its “no Catholics” policy, which the SFA ignored, was because in the new enlightened anti discrimination world that had started to evolve, they knew UEFA/FIFA were casting an eye on their bigoted club policy…hence John Spencer(?) getting signed to put them off the scent. The point is, they fear UEFA, and know they won’t get away with what they’re trying to pull. This is a pivotal moment for Scottish Football and all teams , rich or poor, abiding by the rules and receiving equal treatment under said rules. HH

The whole dynamics of Scottish fitba. changed when wee Fergus and his Bhoys marched up London road.
I am confident that the history books will record that season 2016/2017 will be a golden year for Celtic.
A new Management team,who have revitilsed the players and added some playing gems for a pittance.
A Manager who is humble,articulate,intelligent who is carrying the team forward,his Management skills are brilliant,a top of the class Manager,Brendan you are ra mahn.
The club on the whole is stridindg away from the rest of Scottish fitba.The income this year i am convinced will be the highest ever recorded.Anything is possible,pay of the Coop debt,new players,mibbbee even a hotel within the grounds,laying the foundation for the future,it is just wonderful,sort out Res12.and the jobs a good yin.
Miles ahead of the mankies,who!s new club are trawling along the bottom of the sea.

Aye their license, the way things are going we could be dealing with a third coming.
this plastic version of Rangers struggles on all fronts, look at the performance last night, with the mankies giving every fifty fifty decision to the tribute act. They are undone by their own petard cheating.
The Res 12 guys have to keep the pressure on, as it appears the majority of true football fans are watching the outcome, this limits the SFA trying to move the goalposts
the writing is on the wall, they seriously think the days of Advocatt, Laudrup and Gascoine are just around the corner.

Good article Ralph, good reply Mike.

I think mike makes a good point ( I believe he also makes a good lasagna) when he points out that Res12 came after the event whereas this time we are all prewarned.

Also, the last time there was an impact on Celtic so we are rightly challenging it. It remains a mystery to me why we get no reaction from the other teams affected. This time we won’t be directly affected but hertz , st Johnstone and the sheepish may well be. With this now in the mainstream, they can’t allow their clubs to take a financial hit.

The last time i seen a nose that long it was accompanied by Richard Attenborough commentary.

I think (only an opinion based on what I have read and seen) that TRIFC will hold another vote based on how tight it was and Mr McMoist will this time vote in favour of Res 11 with assurances he will be hailed a true saviour yada yada yada.
This in turn will prompt the SFA to act favourably towards the poor wee stricken venture and somehow push through a License -should they actually qualify for Europe that is.
A the beginning of all this and I mean way back when Murray sold the defunct Rangers to Whyte (His chosen Patsy)it was my opinion he that is Murray would be lying low until all the shite had been totally cleared from the decks then he would make a triumphant return inject cash into what was left of “Rangers”
I still maintain he has a modicum of power at Ibrox be it through a 3rd party (possibly King) and having shed his debts through MIM will look to bank a major nest egg before retiring the hero.
The SFA are obviously complicit with how it all transpired and I think Murray has more than a few bawsacks he could put in a vice if it need be the case.
I don’t think the rest of Scottish Fitba will ever see true justice being served regarding all that went on and I don’t see it getting it either regarding what has yet to transpire?
It will be a series of compromises I feel.
Just how I see it though hopefully I am totally wrong and justice will be done.
I signed the petition either way.

If Minty did that,he would be dafter than a brush.He would lose his pot,a lot of thems support still,the more intelligent ones know who got the club liquidated,the dynamics have now changed,people are more informed and are more aware of both what happened and of how they must comply.
If they get there resolution passed and conform to the FFP then so be it,but they will not now cheat others out of what is rightfully theres.

It would not take mega bucks to turn that basket case into a viable business Mike.
They have a lager fanbase than every other side bar one.
To compete with Celtic I think an annual spend of say £10m (well spent) would make them competitive against us.
The problem they have is the wrong guys have had the keys.
Dicks with loads of talk but little substance.
The Murrays and Ashleys have the clout to turn it into a viable business again and the fact Ashley has been forced away tells me the other is not far off?
The onlt thing that can turn it round is hard cash.
King evidently doesn’t have it or is not comfortable with parting with it.
Like I said it’s only a theory but I think Murray has the means to do this.
As does Ashley.
Perhaps both are biding their time till it goes for a song again?
Time will tell.

Just wanted to mention something, seeing people of all ages in Malones on Sunday, happy, singing, friendly and seeing the joy that Celtic winning brings to so many, is a very powerful thing.
Apart from seeing my own happy and healthy, nothing makes me happier in this life like seeing Celtic supporters happy.

I tend to agree with you Charlie, shit sticks so they will do anything to subvert the rules.
Murray is in the background and is hovering waiting to rejoin.
The good news are the Mankies seriously consider the days of we will spend a tenner for every fiver you spend will return

The dynamics of Scottish Fitba. changed when Fergus arrived at Paradise.Thems were liquidated trying to compete with the Tic.
The arrival of social media,was another dynamic that opened the World to questions,people,business have to be aware of everything that is around them,they may be cast from the same cloth as the ones that were ahead of them,but thankfully the World has changed.

Folks this could all be a moot point if sevco play to form and end up 5th or 6th in the league table. They have been easily beaten by Hearts, they now play the sheepies ( who need to have a good game to restore faith in themselves ) then Hearts again then us – they could end up well down the table at the half way stage. All that said if the SFA try to slip them into Europe in the event that they somehow qualify I expect hearts, Aberdeen and other to kick up a stink

A snidey campaign is at large by the media. They are trying to force a recall on Res 11, to shift the balance to yes.
It could cost more money though, to call an egm, and how stupid would Sally be to vote yes second time around,knowing his already decreasing 1 million shares would lose even more value.
Ralph you make it easy to read, I’m still deeply disappointed, that our board have failed to act on Res 12,on their own merit,but instead have used shareholders to shoulder the burden. Shame on them.
I’m still not convinced they will act to be honest, but do hope I’m wrong. To see Dermot celebrating with the players was wonderful last week,as I know how much he was hurting the last time he visited the ground.

We are very pleased to announce that we will be releasing a special version of Grace next Thursday.
It will be available on iTunes, with all proceeds going to the Green Brigade to help towards hefty legal fees group members face due to the ridiculous “offensive behaviour act” brought in by the Scottish government, it will also help towards displays for the second half of the season
The Green Brigade have worked hard throughout the last 10 years to improve the atmosphere at Celtic park, while using displays to promote and encourage people to get involved with left wing politics, anti fascism and Irish republicanism.
We have a good relationship with the group, playing many fundraisers for them throughout the years, and we look forward to being able to help in a small way, make the second half of the season a success for them and to celebrate the groups 10 year anniversary.
Even if you don’t agree with the GB the Tifo, themselves are worthy of our support and of course the Shamefull bill which is being used to crimalise fans has to be stopped.

“Rangers” will easily finish at least 5 or 6th in the league. The question is will they finish second or third. If we look at their goals for and against, they are about the same level as St Johnstone. Relatively, they do not concede many goals. If they can find a goal scorer they could easily finish in the top three.

They will be helped by the inconsistent form of both The Dons and Hearts. Similarly, they will be assisted by on field decisions, as they were last night.

Unless both the Dons and Hearts find considtent winning streaks, they will finish second or third….probably the latter.

Hi Rebus,

I doubt given what I have seen from them so far and their financial situation that they will be in the top three. Possibly fourth and if they are unable to keep going till the end of the season they may have to go through administration. The down sides are equally if not more likely than the upsides. At the end of the day if they get a free pass to Europe it will be another breach of sporting integrity. The difference is this time we are all watching with eyes wide open.

To change the subject away from the machinations of Sevco and the SFA, i see there are suggestions that we should look at a few Hearts players. Amongst these are the US/Norwegian CF, Johnsen and the Cameroon, Doum. The latter is a centre mid.

While I know that some players can mature late, most that have a background of one or two clubs per season over their career will be simply journeymen. Remember others who had that kind of background, Amido Balde, Hooiveld….nice guys but how did they turn out? Surely we have moved on from this kind of gamble?

On the other hand, Patterson is different. He is finding success after switching positions, just as an Dyk did. He is also young.
I think we may have missed the boat with him, or, at least, end up buying the boat for more than we needed to pay.

We already know that the Board of Directors ‘deliberately’ stalled the Resolutioners knowing fine well there was a ‘time barring’ motion that was exhausted after 5 years. There is nothing left to ‘discuss’ it’s either a ‘Yay or Nay’ from the Club (Peter) or a judicial review and a case brought to the Court of Arbitration of Sport, that ‘WILL’ be crowdfunded. HH

Rebus you are right, they will probably finish top 4 by default.
Because it will not be on their performances on the field. They got out of jail the last two games and were showed up by hearts.
Aberdeen have to step upto the plate. They must win or they will have failed their supporters,and to finish below them,would not bode well with the dandy don supporters.
But St Johnstone and the rest just aren’t good enough to break away from them. They are not good enough to demote them into the bottom 6, where they actually belong judged on performance. But I live in hope.

Callum Paterson of Hearts could do a job at Celtic, i will concede that one to Mike.
Paterson has a good engine on him and is a bit of a unit.

When they posted the fact they made a profit and sent the relevant documentation to the SFA Mr Milne was very adamant with some of his wording that AFC were well within the UEFA Fair play regulations. According to reports he implied that a particular team were not without actually saying it.

I agree Aberdeen and Hearts as well as St Johnstone will have to be up front with this as it will affect their ability to earn money after they have played by the rules. I am unable to see them simply stand silent and allow sevco to be grandfathered into Europe when they have failed to comply with the criteria.

Why the fuck has nobody came out swinging, this is the bit I don’t fuckin get.
Chairmen of every team in the spfl,should be up in arms,yet it’s a group of shareholders from Celtic football club that is leading the fight for sporting integrity in our country.
I mean ffs.
Why hasn’t chairmen from the clubs asked serious questions. Why didn’t our board ask serious questions. Why have they Fannied it off for the past 4 years leaving those brave souls to be ridiculed by every Hun in this wee bigoted country.
It looks like us against them,instead of the football clubs against cheating.
It’s a fuckin disgrace,and I do fear their value to efforts will be in vain.

Destroying the spider’s web does not destroy the spider. Sevco is weak and in their weakness they will experience infighting. The fans are waking up to the truth, Murray thinks he has returned with the gardener and his mentor. The support and share holders are about to fracture. Now is time to decide between a rock, a pair of boots or a Hoover. If timed correctly the web will be the coffin for the spider as it gets crushed wrapped in it’s own web of lies never to return while clearing out and restructuring the SFA all at the same time.

Dunno about you guys but I think Robbie Neilson will regret moving away from Hearts. The English leagues are littered with out of work managers,as clubs chase the golden tickets,without looking beyond the riches.
Sometimes a club fits who you are.
I thought Stubbsy had it at Hibs,and Robbie at Hearts,I do think it will end the same way for him as it did for stubbsy.
A bit like Lambert at Norwich he should have stayed put there.
And a bit like Brendan for us,he should stay here HH
